التنظيم القانوني لمنازعات الاستثمار الأجنبي في السودان خلال الفترة (2013-2022 )

Abstract

تناول هذا البحث التنظيم القانوني لفض منازعات الاستثمار الاجنبي معالجا القصور . وايجاد وسائل او طرق تجلب المستثمر الاجنبي وتكون اكثر عدالة ومرونة وجاذبية لان مشاكل منازعات الاستثمار الاجنبي في السودان وتعدد أساليبها. وذلك مشاكل الاستثمار لازال تعاني الكثير بسبب غموض بعض أحكامه وعدم ضبط الكثير من قواعده . و يعد من موضوعات الساعة التي تثير صعوبات قانونية ليس لها حلول موحدة أو مستقرة في التشريعات الوطنية والدولية . واتبع الباحث المنهج التحليلي والوصفي من خلال تحليل النصوص القانونية الواردة في شان التنظيم القانوني لمنازعات الاستثمار الاجنبي .ومن اهم النتائج التي اليها هذا البحث عدم ثبات التشريعات الوطنية الخاصة بالاستثمار، يؤدي ذلك ألي هروب المستثمرين الأجانب لاستثمار رؤوس أموالهم في السودان ، و لم يتضمن قانون الاستثمار الاتحادي في السودان وسائل محددة وواجبة الاتباع عند نشؤ نزاع استثماري طرف اجنبي . ومن اهم التوصيات التي خرج بها البحث على الدولة الاهتمام بقوانين تشجيع الاستثمار واستحداثها بما يتلازم مع مناخ استثماري جذاب ، و تعديل قانون الاستثمار في السودان ليكون اكثر عدالة ومرونة ويلبي طموحات المستثمر الاجنبي ، وتحديد وسائل فض نزاعات الاستثمار خاصة اذا كان هناك طرف اجنبي منها كا ( التحكيم والتسوية ) كغير طرف قضائي . علي المشرع السوداني عند سن قانون الاستثمار يجب علية استصحاب الجهات ذات الصلة المسئولة بالمتحصلات النقدية في الدولة . لتحديد الكيفية التي تتحصل بها الرسوم النقدية مثل الضرائب والجمارك وغيرها . وسن قانون استثماري اتحادي يطبق في جميع ولايات السودان . Abstract This research dealt with the legal regulation to resolve foreign investment disputes addressing deficits and finding means or ways to attract the foreign investor and to be fair enough , more flexible and attractive , as problems of foreign investment disputes in Sudan and the multiplicity of its methods. These investment problems still lack a lot as a result of unclarity and lack of controlling of its rules .It is one of the current issues that indicates legal difficulties have no unified or fixed solutions in national and international legislation .The researcher adopted the analytical and descriptive method by analyzing the legal texts mentioned in the legal regulations for foreign investment disputes .Some of the important results of this research are the instability of national legislation for investment and this leads to the flight of foreign investors and preventing them from investing their capital in Sudan , and the federal investment law in Sudan does not include specific means and due to follow an investment conflict arises a foreign party. Moreover, some of the important recommendations that the research came about are the consideration of laws to encourage investment and create it in a manner that is in connection with an appealing investment climate . and amending the investment law to be fair enough . flexible and meets the demands of the foreign investor , and identifying means resolving investment disputes ,especially in case of a foreign party .including (arbitration and settlements) as a non judicial party. The Sudanese legislator , at the enactment of investment law , should accompany the relevant authorities responsible for the monetary proceeds in the State .The methods through which the fees are collected such as taxes and customs and others and the enactment of a federal investment law to be applied in all states of Sudan .
