أحكام البطلان وأثره في العقود الإلكترونية في القانون السوداني والمقارن

Abstract

المستخلص الطبيعي ان التعاقدات التي تتم بين الأفراد تسير حسبما أتفق عليه الطرفين إلا أنه أحياناً تعترضها بعض العيوب التي تتسبب ببطلانها مما يحتم على الأطراف معرفة العيوب التي يمكن أن تشوب العقد مما يجعلها معرضة للبطلان وهو موضوع هذه الدراسة البحثية أحكام البطلان وأثره في العقود الإلكترونية وبدأت الدراسة البحثية بتعريف العقد وأركانه وخصائصه وتمييز العقد الإلكتروني عن بقية العقود الأخرى ، كما تم تناول مفهوم البطلان وأنواعه من حيث البطلان المطلق والنسبي ، والآثار المترتبة على البطلان فيما بين المتعاقدين وآثار العقد بالنسبة للغير سواء كان خلفاً عاماً أو خاصاً ، كما شملت الدراسة البحثية التعويض كجزاء للإخلال بالتعاقد .

Abestract Naturally, the contracts concluded betreen individuals goes according to the agreement betreen two partites however, some defects may cause the to benull and un acceptable, so parities most throw these defects. The meain goal of this research is to provisions of nullity and its effects on electronic contracts. We storted by definig the conterct, and its properties and distingus hiry the electronic contract from the rest of the contrats, its also deals with the contract of individually and its types where absotute and relastive individuty. The study also included compensation us a cempensation for breach of contracts.
