دور المنظمات الإقليمية في حماية حقوق الإنسان (دراسة حالة جامعة الدول العربية)

Abstract

هدف البحث إلى : إبراز دور آليات حماية حقوق الإنسان علي المستوي الإقليمي،وبيان مشكلات حقوق الإنسان في الإقليم العربي وأسبابها، والوقوف على مدى فاعلية الآليات الإقليميةودورها في حل مشكلات حقوق الإنسان داخل الإقليم وخارجه،وركزت الدراسة على دور المنظمات الإقليمية في حماية حقوق الإنسان ،واتخذ الباحث جامعة الدول العربية نموذجاً تطبيقياً لذلك. وأُتبع فيها المنهج الوصفي التحليلي والاستقرائي. . وكانت نتائج البحث :أن مشاكل حقوق الإنسان في بعض الأقاليم ترجع أسبابها إلى الفقر والتخلف والصراعات وعدم وجود أنظمة رشيدة تدير تلك الدول. كما أن مشاكل الآليات الإقليمية المعنية بحماية حقوق الإنسان يعتريها الضعف وعدم وجود سلطات واختصاصات واسعة. كما أن انتهاكات حقوق الإنسان من قبل الأنظمة العربية أدت إلي تغييب الديمقراطية وهيمنة الأنظمة المتسلطة وعدم الاعتراف بهذه الحقوق . انحسار دور منظمات المجتمع المدني في مواجهة التحديات المتمثلة في الجهل والأمية والتدني لاقتصادي والتخلف الاجتماعي وعدم الاعتراف بهذه المنظمات من الحكومات العربية . غياب أهم فعالية لحماية حقوق الإنسان تفتقدها جامعة الدول العربية في هذه الحقوق وهي محكمة حقوق الإنسان العربية .وبدون وجود هذه المحكمة لا تجد حقوق الإنسان الوضع الصحيح لها في المجتمع العربي. وكانت أهم توصيات :تعديل ميثاق جامعة الدول العربية فيما يتعلق باختصاص وسلطات الآليات المعنية بحماية حقوق الإنسان .تقديم الدعم بكل أنواعه لتذليل المشاكل والعقبات التي تعتري الآليات الإقليمية المعنية بحماية حقوق الإنسان . لابد من انتهاج النظم الديمقراطية كمنهج للحكومات العربية . تفعيل دور منظمات المجتمع المدني في إنشاء ثقافة حقوق الإنسان .لا بد من قيام محكمة عربية لحماية حقوق الإنسان في جامعة الدول العربية.

Abstract

The study aims at highlighting the role of human rights.protection's mechanisms at the regional level, to identify human rights problems in the Arab region and their causes, and to determine the effectiveness of regional mechanisms and their role in solving human rights problems within and outside the region. The study focuses on the role of regional organizations in protection of human rights. The study takes the League of Arab States as an applied model, and follows the descriptive analytical and inductive method. The study finds that human rights problems in some regions are due to poverty, underdevelopment, conflicts and absence of rational systems that govern the countries of these regions. Also it finds that The human rights regional protection's mechanisms are weak and there is lack of authority and prerogatives. It also finds that human rights violations by the Arab regimes have led to the absence of democracy and domination of the authoritarian regimes and lack of recognition to these rights. One of the findings that the limitation of the role of civil society organizations in facing challenges of ignorance, illiteracy, economic declining, social underdevelopment and lack of recognition to these organizations. It also finds that there is absence of Arab Human Rights Court. The study recommends to amend the Charter of the League of Arab States regarding (prerogative) and authorities of the human rights an freedom protection's mechanisms. And also to provide support to overcome the problems and obstacles in those mechanisms, besides democratic systems must be adopted as an approach for Arab governments, in addition to activate the role of civil society organizations to spread human rights' culture, and it is necessary to set up an Arab court to protect human rights.
