جريمة الإتلاف الجنائي عبر شبكة الإنترنت

Abstract

هدفت هذه الدراسة: (جريمة الإتلاف الجنائي عبر شبكة الإنترنت) إلى بيان الفيروسات من حيث ماهيتها والبرامج الشبي بها والتكييف الفني والقانوني لها، كما هدفت الدراسة أيضاً إلى بيان أركان جريمة الإتلاف الجنائي عبر شبكة الإنترنت، ووضحت كيفية إثباتها، ركز الباحث فيها على أركان تلك الجريمة واتبع فيها المنهج الاستقرائي. ومن أهم النتائج التي توصلت إليها هذه الدراسة: أن شبكة الإنترنت هي الفضاء الرقمي الواسع وهي مسرح الجريمة المعلوماتية لا سيما إذا كانت الجريمة هي جريمة الإتلاف الجنائي عبر شبكة الإنترنت، وأيضاً أن جريمة الإتلاف الجنائي عبر شبكة الإنترنت لا يشترط فيها تواجد الجاني والمجني عليه في مكان واحد كما هو الحال في جريمة الإتلاف الجنائي التقليدية.وعلى صعيد آخر توصلت الدراسة إلى توصيات منها: تقوم كل من نيابة جرائم المعلوماتية ومحكمة جرائم المعلوماتية بإنشاء حسابات رسمية على مواقع التواصل الاجتماعي وإنشاء مواقع إلكترونية رسمية لتلقى البلاغات السريعة والخطرة المتعلقة بإتلاف نظم المعلومات والحسابات الشخصية . كما وصت الدراسة أيضاً بكتابة دراسة من الباحثين بجرائم المعلوماتية تقارن بين حماية برامج الحاسب الآلي وما في حكمها بقانون حق المؤلف والحقوق المجاورة وبين حمايتها بقوانين جرائم المعلوماتية والقوانين الجنائية العامة.

Abstract

This study (the criminal destruction crime) has aimed to explain viruses in terms of what they are, the similar programs and the technical and legal adaptation of them . as the study also has aimed to explain the elements of the criminal destruction crime on the internet and has clarify how to prove it. The researcher has focused on the elements of that crime , and he has followed the inductive method. One of the most important findings of this study is that the internet is the vast digital space and it is seen of the informational crime, particularly if the crime was the criminal destruction crime on the internet. Furter more in the criminal destruction crime on the internet is not require the presence of the perpetrator and the victim in the same place as in the case of the traditional criminal destruction crime. On the other hand this study has revealed recommendations such as: The prosecution of information crimes and the court of information crimes should establish an official accounts on social media platforms and create an electronic websites to receive quick and dangerous proclamation that related to the destruction of information systems and personal accounts. The study also has recommended writing a study by the information crime experts comp airing between protecting of computer programs and it’s like by the law of copywriter right and related rights and between protecting it by the law of informational crimes and the public criminal law .
