الجرائم المعلوماتية وطرق الحماية

Abstract

تعد الجرائم المعلوماتية من الجرائم المستحدثة في العصر الحالي ، لذلك سارعت الدول الي ايجاد قوانين خاصة لمكافحة هذا النوع من الجرائم ، كما عقدت بعض الاتفاقيات الدولية في الإطار الاقليمي كاتفاقية بودابيست – والصادرة عن المجلس الاوربي بتاريخ 23 نوفمبر سنة 2001م حيث ان هذة الاتفاقية تختص بتنظيم كل مايتعلق بالجرائم المعلوماتية في الاطار الاوربي ، اما علي المستوي الدولي فـان الجهود مازالت دون المستوي المطلوب من حيث عقد الاتفاقيات الدولية او القضائية ذات العلاقة بالجرائم المعلوماتية ، ، وقد توصل الباحث الي نتائج اهمها : - ان الجريمة المعلوماتية من الجرائم التي تحتاج الي تظافر الجهود من اجل مكافحتها وضبط تمددها حيث تمتاز هذه الجرائم ، بأنها جرائم عابرة للحدود ويصعب اثباتها -الجريمة الالكترونية تتميز عن الجريمة المعلوماتية في انها تركب على شبكة الانترنت وتوصل البحث الي التوصيات التالية واهمها: - التوصية بأنشاء مركز دولي لمكافحة الجرائم المعلوماتية ويكون مقره الامم المتحدة من اجل تنسيق الجهود بين الدول وابرام الاتفاقيات الدولية ذات الصلة، وعقد المؤتمرات الدولية لتبادل الخبرات لوضع اليات واضحة تجمع عليها الدول من اجل مكافحة الجرائم المعلوماتية، كذلك يتولى هذا وبالتنسيق مع الدول صياغة التعريف جامع مانع للجارائم المعلوماتية تتفق عليه الدول - التوصية بانشاء فسم متخصص على المستوى الدولي لمكافحة الجرائم المعلوماتية تابع لمنظمة الشرطة الدولية (الانتربول) من اجل تنسيق الجهود بين الدول وتبادل الخبرات.

(د) Abstract

Cybercrime is one of the newest crimes in the current era. Therefore, countries have been quick to find special laws to combat this type of crime. Also, some international conventions were held in the regional framework such as the Budapest Convention - issued by the European Council on November 23, 2001. With regard to cybercrime in the European context, at the international level, efforts are still below the required level in terms of concluding international or judicial conventions related to cybercrime, the researcher has reached the most important results:

- Cybercrime is one of the crimes that require concerted efforts to combat it and control its expansion. These crimes are characterized as transnational and difficult to prove.

- Cybercrime is distinct from information crime in that it is installed on the Internet The research reached the following recommendations:

- Recommending the establishment of an international center to combat cybercrime and be based at the United Nations to coordinate efforts between States and conclude the relevant international conventions, and the convening of international conferences to exchange experiences to develop clear mechanisms by which States to combat cybercrime, also in coordination with States drafting the definition Anti-crime offenses agreed by States - Recommending the establishment of a specialized section at the international level to combat cybercrime of the International Police Organization (Interpol) in order to coordinate efforts between countries and the exchange of experiences
