ضمانات الحقوق والحريات الشخصية في القوانين السودانية والمعاهدات الدولية دراسة مقارنة

Abstract

هدفت الدراسة الي تناول ضمانات الحقوق والحريات الشخصية في القوانين السودانية والمعاهدات الدولية وايضاح اهمية الضمانات للحقوق والحريات الشخصية علي المستوي الوطني والدولي سواء كان الانتهاكات من الجاني الموظف العام او احد الناس واتبع الباحث المنهج التحليلي المقارن . كانت نتائجها : ان الضمانات وفقا للدستور توفر مناخ الحرية وضمان الحقوق الاساسية لجميع الافراد دون تميز . أن الاتفاقيات الدولية والاقليمية حرصت لتمتع الانسان بالضمانات للحقوق والحريات الشخصية للفرد . كانت التوصيات : يوصي الباحث كل من يستغل نفوذه في انتهاك الحريات والحقوق الشخصية تتم مسالته ومعاقبته . علي الدولة الالتزام بالمعاهدات الدولية والاقليمية المتعلقة بالحماية للحقوق والحريات الشخصية وذلك عن طريق توطئتها في نظامها الداخلي .

Abstract The study aims at addressing the guarantees of personal rights and freedom in the Sudanese law and international treaties and to explain their importance at the national and international level whether the violator is a public employee or an ordinary person, the study follows the comparative analytical methodology. The study comes out with a result that the guarantees in accordance with the Constitution provide a climate of freedom and guarantee the fundamental rights of all individuals without discrimination and also that international and regional convention are concerned to enjoy rights and personal freedom of the individual. The study recommends that anyone who exploits his influence in violation of personal freedom and rights should be punished; also the State shall abide by international and regional treaties relating to the protection of personal rights and freedom through its internalization in its rules of procedure.
