الأثــــر القـــانوني لبطاقــات الدفع الالكتـــــروني

Abstract

أن التطور الهائل في استخدام شبكات الاتصالات في المعاملات التجارية اوجب على المصاريف تحديث وسائل الدفع حتى تصبح قادرة على إتمام عمليات التسوية بواسطتها تظهر ما يسمى بوسائل الدفع الالكتروني فالمشرع السوداني قام بإصدار قانون المعاملات الالكترونية 2007 م . وكذلك قانون جرائم المعلوماتية 2007 م و عددا من اللوائح من اجل تحقيق تنظيم قانوني للتعامل بتلك الوسائل و قد تناول الباحث وسائل الدفع الالكتروني بالدراسة و البحث في ضوء أحكام تلك التشريعات. ان السمة المميزة لنصوص قانون المعاملات الالكترونية لسنة 2007 م أنها جاءت بإحكام مجملة فيما يتعلق بوسائل الدفع الالكتروني ولقد حاول الباحث توضيح الأحكام التفصيلية لتلك الوسائل مسترشدا في ذلك بكتب الفقه اما نصوص قانون جرائم لسنة 2007 م فقد جاءت واضحة فيما يتعلق بالحماية الجنائية لتلك الوسائل و كذلك فقد جاءت حاسمة لكثير من الجدل الذي دار حول التكييف القانوني للتعدى على المال المدار بواسطة شبكات الاتصالات. لقد ختمنا بنتائج أهمها: 1/ هي أما إجراءات إدارية أو إجراءات تقنية تتخذ من قبل المصدر أو إجراءات وقائية تتخذ من الحامل والمصدر . 2/ بطاقات الدفع الالكتروني تعمل في ظل شبكة اتصالات وانترنت قوية لذلك لابد من تقوية شبكات الاتصال المحلية حتي تواكب الشبكات العالمية للاستفادة منها عالميا ومحليا لان فضاء الاتصالات فضاء ليس له حدود وأصبح العالم قرية صغيرة. توصلت إلى توصيات منها : 1/حتمية التعاون الدولي ،وضرورة تكاثف الجهود وتضافرها للحد من الاستعمالات غير المشروعة أذا استحال القضاء عليها جميعا . 2/ ضرورة وجود شبكة اتصالات قوية وتقوية شبكة انترنت قوية بين كل الجهات حتى يتم الاستخدام الأمثل لبطاقات الدفع الالكتروني . Abstract

The tremendous development in the use of telecommunications networks in commercial transactions necessitated expenses to modernize payment methods in order to be able to complete the settlement processes through which they show what is called electronic payment methods. The Sudanese legislator issued the Electronic Transaction Law 2007 AD. As well as the Information Crime Law 2007 AD and a number of regulations in order to achieve a legal organization to deal with these means, the researcher has discussed the means of electronic payment in the study and research in the light of the provisions of those legislations. The distinctive feature of the provisions of the Electronic Transactions Act of 2007 is that they came in bulk provisions regarding electronic payment methods. The researcher has tried to clarify the detailed provisions of these methods guided by that in books of jurisprudence. As for the provisions of the Crimes Law of 2007 AD, they came out clear with regard to the criminal protection of those methods as well as It was crucial to much of the controversy surrounding the legal adaptation of the infringement of money managed by telecommunications networks. We have concluded with the most important results: 1/ It is either administrative or technical measures taken by the source or preventive measures taken by the holder and the source. 2/ Electronic payment cards work in the shadow of a strong communications and internet network. Therefore, local communication networks must be strengthened in order to keep pace with global networks to benefit from them globally and locally because the communication space is a space that has no borders and the world has become a small village. I made recommendations, including: 1/ The imperative of international cooperation, and the necessity of intensifying and concerted efforts to reduce illegal uses if it is impossible to eliminate them all.
