وضــع الدساتيـر دراســة حالـة دستور السـودان الانتقالي فـي الفتـرة 2005 ـــــ2017 م

Abstract

تهدف الدراسة إلي معرفة مفهوم الدستور وهل يعتبر من المفاهيم القانونية الرائدة التي تثير مجموعة من الإشكالات في الفقه الدستوري ,كما وضحت انه يعلو علي كل قوانين الدولة وأعرافها وهذا هو أهم المبادئ التي ترتكز عليها كل الدساتير , وقد توصلنا بالدراسة إلي أن الدستور له عدة طرق لإنشائه منها الديمقراطي ومنها غير الديمقراطي. فإن تم وضع الدستور عن طريق الحاكم وذلك في أسلوب المنحة غير الديمقراطي ، هنا تتجلي السلطة التأسيسية الأصلية في الحاكم ، أما إذا كان وضع الدستور عن طريق العقد فتكون السلطة التأسيسية الأصلية تتكون من الشعب والحاكم معا. و قد يوضع الدستور بطريق ديمقراطي ويتخذ أسلوب الجمعية التأسيسية أو الاستفتاء الدستوري سبيلا ن وهنا تظهر السلطة التأسيسية الأصلية في الشعب . بعبارة أخري فان السلطة التأسيسية الأصلية لا تخرج عن الحاكم أو الحاكم والشعب معا أو الشعب. جدير بالذكر إن السلطة التأسيسية الأصلية وهي تمارس سلطتها في وضع الدستور لا تخضع لأي قيود دستورية وما ذلك إلا لأنها سابقة في وجودها علي الدستور ، فهي التي وضعت الدستور بمعني إن السلطة التأسيسية الأصلية يكون لها مطلق الحرية وهي تضع الدستور.

Abstract

The study aims to know the concept of the constitution and whether it is one of the leading legal concepts that raise a number of problems in the constitutional jurisprudence. It also clarified that it transcends all the laws and customs of the state. This is the most important principle on which all constitutions are based. Democratic and non-democratic ones. If the constitution is drawn up by the ruler in the non-democratic way, the original constituent authority shall be reflected in the ruler. If the constitution is established by contract, the original constituent authority shall consist of both the people and the ruler. The Constitution may be laid down in a democratic manner and the method of the Constituent Assembly or constitutional referendum is adopted. Here, the original constituent authority in the people appears. In other words, the original constituent authority does not deviate from the ruler, the ruler, the people, or the people. It is worth mentioning that the original constituent authority exercising its authority to establish the constitution is not subject to any constitutional restrictions, and this is only because it is predetermined in its existence on the constitution. It established the constitution in the sense that the original constituent authority has absolute freedom and establishes the constitution
