تنفيذ الالتزام الدولي في الرقابة البحرية لدولتي الميناء والساحل وفقاً لقانون النقل البحري السوداني لسنة 2010م والنظام القانوني للمنظمة البحرية الدولية (IMO)

Abstract

هدف البحث تحقيق نتائج علمية يمكن تطبيقها لحل المشكلات البحرية، المتعلقة بالرقابة البحرية والخبراء البحريين، وإلى تطوير مؤسسات الرقابة البحرية لتواكب المتغيرات المحلية والدولية في مختلف مساراتها وحس الدولة لتصادق علي الإتفاقيات الدولية البحرية التي لم تصادق عليها والإلتزام بتنفيذ ما صادقت عليه من اتفاقيات بما فيها من فوائد ترتقي بالإنسان وتساهم في وضعه الاقتصادي الذي ينعكس إيجاباً على واقعه الإجتماعي، وبالتالي تحسين وضع الدولة إتبع الباحث فيها المنهج التحليلي والمقارن والوصفي، وفقاً للقانون البحري السوداني لسنة 2010م والنظام القانوني للمنظمة الدولية البحرية . من أهم النتائج التي توصل اليها البحث ان عمليات الرقابة البحرية وفقاً للقانون السودان (قانون النقل البحري لسنة 2010م والنظام القانوني للمنظمة الدولية البحرية غير مطبق بشكل كامل وهذا خلق كثير من المشكلات السودان لم يصادق علي العديد من الاتفاقيات الدولية المعنية بالرقابة البحرية لم يتم تنفيذ الإلتزام الدولي تجاه الاتفاقيات التي صادق عليها السودان. توصيات البحث : تنفيذ ما صادق عليه السودان من اتفاقيات دولية معنية بالرقابة البحرية وبإلتزامات دولتي الميناء والساحل . يوصي البحث بفصل إدارة الرقابة البحرية عن هيئة الموانئ وجعلها إدارة مستقلة حتي تتحقق عملية الرقابة البحرية . يوصي البحث بان يتم تقديم تدريب نوعي بشكل مستمر علي النطاق الدولي الفني المتخصص. توصي الدراسة بأن تهتم الدولة بالصناعة البحرية لما لها من ساحل بحري كبير جداً وغير مستقل فإن إستقلاله بالوجه الأمثل يسهم في الدخل القومي للدولة . The goal of the research is to achieve scientific results that can be applied to solving maritime problems related to maritime control and marine experts, and to develop maritime control institutions to keep pace with local and international variables in their various paths and the sense of the state to ratify international maritime agreements that have not ratified them and to commit to implementing the agreements it has ratified, including from Benefits that advance the human being and contribute to his economic situation, which is reflected positively on his social reality, and thus improving the state's situation. The researcher followed the analytical, comparative and descriptive approach in accordance with the Sudanese Maritime Law of 2010 and the legal system of the International Maritime Organization One of the most important findings of the research is that maritime control operations in accordance with the law of Sudan (the Maritime Transport Law of 2010 AD and the legal system of the International Maritime Organization are not fully implemented and this has created many problems Sudan has not ratified many of the international conventions on maritime control The international commitment has not been implemented. Regarding the conventions ratified by Sudan. Research recommendations: Implementation of the international conventions ratified by Sudan concerned with maritime control and the obligations of the port and coastal states. The research recommends separating the Maritime Control Department from the Ports Authority and making it an independent department until the maritime control process is achieved. The research recommends that qualitative training be provided on an ongoing basis on the international technical and specialized scale. The study recommends that the state pay attention to the maritime industry, because it has a very large and independent sea coast. Its independence in the best way contributes to the national income of the state.
