التطبقات العملية للإتفاقية الدولية لمنع التلوث من السفن(ماربول) دراسة حالة هيئة الموانئ البحرية – بورتسودان- السودان فى الفترة من2013 – 2017

Abstract

تهدف هذه الدراسة إلى كفالة حق الإنسان فى العيش فى بيئة صحية من خلال العمل على سنَ تشريعات وقوانين رادعة للحفاظ على البيئة وتحسينها للأجيال الحاضرة والمستقبلة. وركزت الدراسة على دراسة حالة هيئة الموانئ البحرية- بورتسودان- السودان خلال الفترة 2013-2017 ، وإتبع الباحث المنهج التحليلى والوصفى والمقارن. وكانت نتائجها : من خلال الدراسة تبين أن هنالك بعض الأحكام المتعلقة بالتلوث تم تطبيقها بشكل إيجابى وتركت اثارها على البيئة البحرية على الساحل السودانى. كما أن هنالك جانب من الأحكام لم يتم تطبيقها بما يتواءم مع إلتزامات السودان بتعهداته الدولية مما يشكل أثاراً سلبية فى مجال حماية البيئة البحرية من التلوث. وكانت توصياتها : يوصى الباحث الجهات المختصة بإنشاء محكمة بيئة بحرية ببورتسودان بسلطات وإختصاصات واسعة. توصى الدراسة بأن تنضم الدولة للإتفاقيات المعنية بمنع تلوث البيئة البحرية، وأن تبذل قصارى جهدها لتنفيذ الإتفاقيات المصادق عليها.

(د) Abstract

The study aimed to grantee the human right in living in a healthy environment by working on making and dissuasive legislation to keep and improve the environment to present and future generation. The study takes sea port corporation-port Sudan- as a sample during the period 2013 to 2017، the study follows the analytical descriptive and comparative methodology. The research findings were: There are rules relating to pollution has been applied positively and it has good effect on marine environment on Sudanese coast. Also there are parts of rules that that are not applied that go with international Sudanese obligations that has a negative effective in protecting marine environment from pollution. Study Recommendations are: The state concerned authorities should establish a marine environment courts in Port Sudan with specialize. And extend authorities also it recommends state should join the mentioned agreements to prevent marine pollution and make maximum effect to carry out the signed agreement.
