دور معتمدية شؤون اللاجئين في حماية حقوق اللاجئين (بالتطبيق على ولايات السودان الشرقية) (دراسة مقارنة)

Abstract

المستخلص هدف البحث إلى تسليط الضوء على دور معتمدية شؤون اللاجئين في ولايات شرق السودان، وتقديم معلومات حقيقية عن اللاجئين فيها، وذلك لإيجاد حلول لمشكلته المتمثلة هل لمعتمدية شؤون اللاجئين في ولايات شرق السودان دور في قضايا اللاجئين ومن هو اللاجئ وحقوقه وواجباته في الفقه الإسلامي والقانون. ولبيان أهميته في قلة الدراسات المتعلقة بظاهرة اللجوء في شرق السودان وبيان دور معتمدية شؤون اللاجئين فيها، واتبع الباحث في هذه الدراسة المنهج الاستقرائي والتحليلي والوصفي والمقارن لتحقيق الدراسة، وأجريت الدراسة على حالة اللاجئين في ولايات شرق السودان – ولاية كسلا خلال الفترة من 2010-2018م. واهم النتائج التي توصل إليها البحث ليس هناك سمة شك أن الشريعة الإسلامية وضعت قواعد مراعية فيها حق اللجوء وأهمية الملجأ وذلك أن مصدره في الشريعة الإسلامية هو الله الذي يسمو اسمه فوق كل شئ وهو ما جعل لمبدأ اللجوء في الشريعة الإسلامية ميزة لا تتحقق بأي حال من الأحوال لأي قوانين دولية أو تنظيمات بشرية، وأن اللجوء في الولايات الشرقية الثلاثة (كسلا – القضارف – البحر الأحمر) له أثر على المجتمع سياسياً واقتصادياً واجتماعياً وثقافياً. وختم البحث بأهم توصيات هي زيادة الدعم الأممي الكافي في توفير حياة أفضل للاجئ دون أن تتأثر دولة الملجأ اقتصادياً وتوفير معسكرات مغلقة وذلك حفاظاً من المهددات الأمنية التي تقع على اللاجئ ودولة الملجأ.

Abstract

This research aims to investigate the role of the United Nations Refugees Commission ( UNRC) in eastern Sudan States . The study intends to provide true information about the situation of the refugees in these states. Therefore, the research inquires whether the (UNRC) in eastern Sudan has a role in refugees affairs and also inquires about the definition of a refugee as well as inquiry into the rights and duties of a refugee in Islamic Fikh and general law The study is significant as it provides information regarding refuge phenomenon and the role of the refugees commission in eastern Sudan. The researcher used the inductive, deductive , analytical and descriptive as well as the comparative methods to achieve the study. Samples were taken from refugees in Kassala State in the period between 2010- 2018. The following most important results have been found: Islamic Sharia laws have set ideal rules, not found in any other legislations, for refugee situation and the right to take refuge as they come from almighty God. Refuge in the three eastern states ( Kassala – Gedaref – Red Sea ) has political , economic , social and cultural impact on the local community. The study recommends that the United Nations should increase its support to provide better life for refugees so that the economic situation of the host country must not be affected. There should be closed camps for refugees to ensure security for both the refugee and the host country.
